These Terms of Service (“Terms”) govern use of the Dr. Kaimono shopping comparison app (“the app”) provided by Tardigrader.App (“we”). By using the app, you agree to these Terms.
1. The app
The app helps you reach search pages on online stores, marketplace services, and other search services (“third-party services”) using the terms and filters you enter. The app does not sell, process payment for, deliver, or broker products.
2. Third-party services and transactions
Prices, points, shipping fees, inventory, item condition, listings, and other information on third-party services are provided by those services or their sellers and may change. Always verify the latest terms on the destination service before purchasing.
Transactions are between you and the relevant merchant, seller, or service provider. We are not a party to them. You must review and follow each third-party service’s terms, privacy policy, and other conditions.
3. Affiliate programs
After any required review and registration, the app uses the Amazon Associates Program, Rakuten Affiliate, Mercari Ambassador, and ValueCommerce Affiliate. We may receive money, points, or other compensation when a qualifying action, such as a purchase, occurs through an eligible link. We do not separately charge you for using an affiliate link.
As an Amazon Associate, Tardigrader.App earns from qualifying purchases.
Eligible links contain advertising or promotion. We identify eligible links so users can recognize their commercial nature. Our disclosures, descriptions, and link placement follow applicable guidance from Japan’s Consumer Affairs Agency and the rules and guidelines of each program.
Participating programs, eligible services, conversion terms, and compensation may be changed or discontinued by us or a program operator.
4. Local data
Search history, favorites, filters, and settings are stored on your device. You are responsible for managing this data. It may be lost because of device failure, migration, app deletion, or other causes. We do not guarantee backup or recovery.
5. Prohibited conduct
You may not:
violate laws, public policy, these Terms, or a third-party service’s terms
infringe the rights or interests of us, a third-party service, or another person
place excessive load on or interfere with the app or a third-party service
exploit an app defect for an improper purpose
analyze, modify, or reverse engineer the app, except where permitted by law
engage in other conduct we reasonably determine to be inappropriate
6. Intellectual property
Rights in the app, website, text, images, software, and other content belong to us or their lawful owners. Names, logos, product images, and other materials belonging to third-party services remain the property of their respective owners. These Terms do not transfer those rights to you.
7. Changes, suspension, and discontinuation
We may change, suspend, or discontinue all or part of the app for maintenance, third-party service changes, outages, or other reasons. We will provide advance notice where practical, except in urgent cases.
8. No warranties
We do not warrant the app’s accuracy, completeness, usefulness, fitness for a particular purpose, continuous availability, compatibility with third-party services, or freedom from defects. Search results or filters may not work as intended following changes to third-party services.
9. Limitation of liability
Except in cases of our willful misconduct or gross negligence, we are not liable for damage arising from use or inability to use the app, information or transactions on third-party services, loss of local data, or similar causes. This limitation does not apply where prohibited by Japan’s Consumer Contract Act or other mandatory law. Where we are liable for ordinary negligence, liability is limited to direct and ordinary damage.
10. Minors
Where required by law, minors must obtain consent from a parent or other legal representative before using the app.
11. Changes to these Terms
We may update these Terms in response to legal, product, or other changes. We will announce material changes on this website or in the app. Continued use after a change constitutes acceptance of the updated Terms.
12. Governing law and jurisdiction
These Terms are governed by Japanese law. Disputes concerning the app or these Terms are subject at first instance to a court in Japan having jurisdiction under applicable law.
